THE CLIENT

1.     We hereby authorise Tess Maree of That Little Studio Co. to arrange the photography of our Wedding, in accordance with the details submitted on the 'Wedding Details Form'.  We understand there is a 3-day cooling-off period from the date of signing this contract.

2.     We have received, read and understand Tess Maree of That Little Studio Co. “Pricing Collections” and “Additional Charges”. We have also read & understood the “Frequently Asked Questions”.

3.     At the bottom of this Agreement we have chosen the Price Collection we would like and we agree that the payment of the initial non-refundable 20% confirmation fee secures the booking with Tess Maree as per the details submitted on the 'Wedding Details Form'.

4.     We agree to pay the non-refundable 20% confirmation fee invoice that we will receive upon accepting this Contract of Agreement within 7 days to secure the date and time of the booking. 

5.    We also agree to pay the remaining balance 3 weeks prior to the Wedding Day.  Failure to do so gives Tess Maree the right to refuse to carry out the full photographic service.

6.     Any additional costs incurred for photography such as location fees etc. are the Bride & Groom responsibility and paid for separately. I.e. Council or Parks Photography Fees if applicable. 

7.     In the event of cancelation of the Wedding or a change of mind within two months of the Wedding Day, we agree that the 20% confirmation fee will be forfeited.

8.      In the event of cancelation of the Wedding or a change of mind within 2 weeks of the Wedding Day, we agree that 75% of the total amount paid will be forfeited. 

9.     The details & times listed on the 'Wedding Details Form' are part of this agreement and we agree to make every effort to accommodate in order for Tess Maree to fulfil her contracted photographic duty. We acknowledge Tess Maree of That Little Studio Co. cannot accept responsibility for the ‘extent’ of the photographic coverage if these details are incorrect or if we chose not to follow the agreed to schedule.

10.     We accept the responsibility to contact Tess Maree, at least two weeks prior to the wedding, to confirm the details on the 'Wedding Details Form' are correct and there are no alterations.

11.     We agree to immediately advise Tess Maree in writing of any alterations in the details listed in the 'Wedding Details Form' including postponement or cancellation of the wedding.

12.     To avoid disruption to the photographic coverage and to allow Tess Maree to fulfil her contracted duty, it is asked that family and friends be considerate and no interference with other DSLR or professional cameras partake in the event. Phones cameras are acceptable at the discretion of Tess Maree.  

13.     We agree the Copyright of all photographs is owned by Tess Maree of That Little Studio Co.  We give permission for Tess Maree to use any image of our wedding for industry promotion and competitions and for the reasonable general promotional advertising for Tess Maree of That Little Studio Co. on her social media platforms, printed collateral and website. Any other usage for any other purpose is to be renegotiated between the parties and requires specific permission.

14.     We understand the turnaround time to receive our digital images is between 6-8 weeks and If we order printed albums will be advised of the turn-around time once ordered.  

15. We understand these photographs are for personal use and can be shared digitally between family & friends. We understand that these photographs are only to be used as agreed and may not be manipulated or altered in anyway (e.g. processed through phone filters) unless written approval has been granted by Tess Maree of That Little Studio Co. We understand these photographs are a representation of Tess Maree’s artistic license & work and by altering any images we are infringing upon Copyright laws. 

16.     We understand the digital negatives (RAW Files) remain the property of Tess Maree of That Little Studio Co. and these files will not be released unedited. All final edited files will be kept archived by Tess Maree of That Little Studio Co. 

17.     Regarding the order of printed albums or photographs, we understand that: 

a.     All printed orders for the Wedding will be considered as one order, regardless of how many individual parties request photographs.  We will be responsible for the entire order and no partial orders will be given out until the balance of the Order is paid.

b.      All orders shall remain the property of Tess Maree of That Little Studio Co. until full payment has been made.

c.     Should we fail to pay & collect the printed order within fourteen (14) days of notification of order completion, the order shall be in default and Tess Maree shall charge a default charge of $5.00 per week.  In addition, we acknowledge that no future orders will be processed until the Order is paid in full & collected. 

d.      All orders are to be in writing and an invoice from Tess Maree of That Little Studio Co. issued. 

e.     Any freight or postage of the Order will be paid by us, the Bride & Groom.

18.      I understand that Tess Maree of That Little Studio Co. has no control over the environment in which the photographs and albums are kept or displayed. Photographs have limited life expectancy when exposed to strong and prolonged sunlight or fluorescent light sources.  Photographs will retain their colour and brilliance much longer showed in a custom-made frame displayed in shaded areas with quality lighting, while albums are better stored in low light, dry & dust –free conditions.

THE PHOTOGRAPHER – TESS MAREE OF THAT LITTLE STUDIO CO.

1.     Should I, Tess Maree, not be available for any reason, I will notify the Bride and Groom of the change as soon as it is known and provide another photographer with equivalent skills or refund the deposit or amounts paid.

2.     Tess Maree of That Little Studio Co. shall carry out this assignment with due and professional diligence.  Elements beyond the photographers control include equipment failure, damaged or faulty memory cards, loss of printed material in transit between the Printing Studio and Professional Laboratories employed by Tess Maree of That Little Studio Co. Industrial disputes, civil disturbances, or weather conditions which may inhibit or prevent Tess Maree of That Little Studio Co. completing in whole or in part of this assignment.  In this case Tess Maree shall not be liable for its complete performance of the assignment.

It is agreed that the liability of Tess Maree of That Little Studio Co. shall be limited to a refund of any money paid under this agreement, which shall be in full & final satisfaction of any damage or loss suffered.
